Data protection policy

1. Data controller

The data controller within the meaning of the revFADP (and, where applicable, the GDPR) is Noukan Industries GmbH, Bundtenstrasse 9, 4524 Günsberg (Switzerland). For any data protection question, write to us at the address shown at the bottom of this page.

2. Data we process

Depending on your interaction with us, we may process the following categories of data:

• Contact data you provide (name, company, email address, content of your message) via the contact form or by email.
• Technical data generated automatically when browsing the site (IP address, browser type, pages visited, timestamp) through server logs.
• Data required to perform an engagement or to operate a hosted solution, within the scope of the agreed service.

3. Purposes and legal bases

We process your data for specific purposes, on the following legal bases:

• Responding to your enquiries and maintaining the pre-contractual relationship (legitimate interest / pre-contractual measures).
• Performing our services and contracts (performance of the contract).
• Ensuring the security, stability and improvement of the site (legitimate interest).
• Complying with our legal obligations, in particular accounting ones (legal obligation).

4. Cookies and server logs

The site uses only technically necessary cookies (e.g. to remember the language) and no advertising trackers. Details are set out in our cookie policy. Server logs are kept for security and diagnostic purposes, then deleted or anonymised.

5. Recipients and processors

Your data is never sold. It may be entrusted to processors (e.g. hosting, email) acting on our instructions and bound by confidentiality, strictly to the extent necessary to provide the service. For self-hosted deployments, your data remains entirely on your own infrastructure.

6. Transfer of data abroad

Our hosted services rely on infrastructure located in Switzerland. If, exceptionally, data had to be transferred to a country without an adequate level of protection, we would put in place appropriate safeguards (standard contractual clauses or equivalent) in accordance with the revFADP.

7. Retention period

We keep your data for as long as necessary for the purposes described or as required by legal periods (in particular accounting retention), then delete or anonymise it.

8. Data security

We take appropriate technical and organisational measures (encryption of transmissions, access control, data minimisation) to protect your data against unauthorised access, loss or misuse.

9. Your rights

Within the limits of applicable law, you have the following rights regarding your personal data:

• Right of access to and information about the data processed.
• Right to rectification of inaccurate data.
• Right to erasure and to restriction of processing.
• Right to object to processing and to withdraw consent at any time.
• Right to portability of the data you provided to us.

10. Automated decisions

We do not use automated individual decisions or profiling producing legal effects concerning you.

11. Changes

We may adapt this policy in line with the evolution of our services or legislation. The version in force is the one published on this page.

Supervisory authority

You have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern. If you reside in the European Union, the supervisory authority of your country of residence is also competent.
